New Round of Consumption Vouchers (Phase II) Offer- Standalone Device Instalment Offer (the "Offer") - Terms and Conditions


General

1. By enjoying the Offer, you confirm to have read, understood and accepted theses terms and conditions.
2. The Offer is available to selected existing CSL postpaid customers on a by-invitation only basis.  Eligible customers must
 
  1. purchase a designated device (the "Designated Device") under the Offer;
  2. pay the price of the Designated Device (the "Purchase Price") by two or more purchase instalments;
  3. elect to pay the Subsequent instalment of the Purchase Price with a Tap & Go account which is designated to receive the New Round of Consumption Vouchers (Phase II) (the "Tap & Go CVS Account"); HKT Payment Limited ("HKT Payment") operates and is responsible for Tap & Go (Stored Value Facilities Licence No. SVF0002), a stored value facility operator designated by the Government under the CVS and is subject to its relevant terms and conditions;
  4. elect to receive SMS bill;
  5. be a Hong Kong permanent resident aged 18 or above with a Hong Kong identity card.
3. To enjoy the Offer, you must have a remaining unexpired commitment period of at least 12 bill months under your contract with us for a designated postpaid plan (the "Plan").
4. For the purpose of these Terms and Conditions, the "Earliest Disbursement Date(s)", means, in respect of each instalment of disbursement under the Phase II of the New Round of Consumption Voucher Scheme of the Hong Kong Special Administrative Region Government (the "Government") in 2022 (the "Scheme"), the earliest date on which such instalment under the Scheme is disbursable to any person under the Scheme as announced by the Government


Payment of Purchase Price

5. All Purchase Price must be settled by two or more purchase instalments as the case may be.  The first purchase instalment shall be the balance of the Purchase Price after deducting HK$5000 (the "First Purchase Instalment") and the subsequent purchase instalment(s) will be in the total sum of HK$5000 (the "Subsequent Purchase Instalment(s)").
6. The First Purchase Instalment must be settled forthwith upon purchase.
7. The Subsequent Purchase Instalment(s) must be settled by Tap & Go CVS Account, and you must sign the Tap & Go Direct Debit Authorization Form. 
8. The Subsequent Purchase Instalment(s) will be deducted from your designated Tap & Go CVS Account forthwith on the corresponding Earliest Disbursement Date(s) of each instalment of disbursement under the Scheme as announced by the Government and in the amount equivalent to the amount of each corresponding instalment of disbursement.
9. By way of example, if it is announced by the Government that the disbursements under the Scheme will be disbursable as early as, for example, on 1 August 2022 in the sum of HK$2000, on 1 September 2022 in the sum of HK$3000, the Subsequent Purchase Instalment(s) will be deducted from your designated Tap & Go CVS Account in the amount of HK$ 2000 on 1 August 2021, in the amount of HK$ 3000 on 1 September 2022 respectively. 
10. If the relevant instalment(s) of the Purchase Price is not successfully deducted from your designated Tap & Go CVS Account for whatever reason, the unpaid amount will be deducted under your designated autopay instructions designated in the Mobile Service Agreement (if any) or you must pay the unpaid amount using other payment methods acceptable to us in accordance with the Mobile Service Agreement. 
11. Please note that the figures in example set out in paragraph 9 are for illustration purpose only.  The details of Scheme (including but not limited to the actual amount and schedule of disbursements) are to be published by the Government. The Purchase Price payment and bill schedule may be changed by us from time to time in our absolute discretion in light of any changes to the terms and conditions of the Schem.
12. If the Earliest Disbursement Date(s) of any one or more instalment of the disbursement(s) under the Scheme does not fall on a date before 31 December 2022, we reserve the right to bill and charge the Subsequent Purchase Instalment(s) of the Purchase Price by 1 January 2023.
13. If there are any Other Fees and Charges in the bill, you must pay the same using other payment methods acceptable to us in accordance with the Mobile Service Agreement.
14. Any overpaid amount will be carried forward to your next bill unless otherwise indicated by us.
15. If the Plan is terminated before expiry of Commitment Period for any reason, you will be required to pay the remaining balance of the Purchase Price forthwith as well as an early termination charge in a sum equivalent to the remaining balance of the Plan fee.


Bill issuance

16. The bill(s) for the Subsequent Purchase Instalment(s) of the Purchase Price will be issued within 30 calendar days after the Earliest Disbursement Date(s).
17. Notwithstanding the bill issuance schedule, you are liable to pay the Purchase Price in accordance with the schedule set out in Clauses 6, 7 and 8 hereof.
18. Save for the Purchase Price, the bills for all other fees and charges such as fees for value-added services, IDD charges, direct carrier bills and thereafter usage (the "Other Fees and Charges") will be issued to you on a monthly basis. 
16. For avoidance of doubt, the above payment timelines are applicable regardless of whether and when you are eligible to claim or receive, or have received any disbursements under the Scheme by the Earliest Disbursement Date(s) or at all.


Others

20. Unless otherwise specified, the offers and privileges under the Offer cannot be used in conjunction with any other discount, offer or promotion and is non- transferable nor exchangeable for cash or other products/services.
21. We reserve the right to terminate or change the Offer and/or these Terms and Conditions (including, but not limited, to the billing schedule) at any time without prior notice in the event of any dispute. We reserve the right to make the final decision in the event of any dispute.
22. For avoidance of doubt, you are liable to pay the Purchase Price in its entirety and in accordance with the timelines set out above regardless (i) when you will receive the disbursements under the Scheme and (ii) whether you are eligible for any disbursements under the Scheme at all.

24. HKT Payment is not responsible for the Offer and accepts no liability for the quality of the Offer of any other matters relating to any products and/or services provided by CSL.
25. If there is any inconsistency between the Chinese and English versions of these terms and conditions, the English version shall prevail.
